Terms of Service

The agreement between you, other users, and FiveM Market. Last updated 2026-04-16.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of FiveM Market (the "Marketplace"), operated by FiveM Market ("we," "us," or "the Marketplace"). By creating an account, browsing, purchasing, or listing content on the Marketplace, you agree to be bound by these Terms. If you do not agree, do not use the Marketplace.

These Terms apply to all users — buyers, sellers, and visitors. Additional rules may apply to specific features (seller listings, commission work, hosting partnerships), and those are incorporated by reference when relevant.

2. Eligibility & Accounts

You must be at least 16 years old to create an account, or the age of digital consent in your jurisdiction if higher. By registering you represent that the information you provide is accurate and that you have the authority to enter into these Terms (either personally or on behalf of an organization you represent).

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify support@fivem.market immediately of any unauthorized access. We may suspend or terminate accounts that we reasonably believe have been compromised, are operated fraudulently, or violate these Terms.

3. The Marketplace's Role

FiveM Market is a technology platform that connects buyers with third-party sellers of digital content. We are not a party to the agreements between buyers and sellers. We do not author, produce, or warrant the listed content. We provide vetting, payment processing, dispute resolution, and buyer-protection services, but the underlying transaction is between you and the seller.

We reserve the right (but are not obligated) to review, remove, or refuse to publish any listing or user content that violates these Terms or that we reasonably believe is harmful, illegal, or inconsistent with the Marketplace's standards.

4. Seller Obligations

If you list content on the Marketplace, you represent and warrant that:

  • You own or have all necessary rights and licenses to distribute the content you list.
  • Your listing is accurate — descriptions, screenshots, compatibility claims, delivery timelines, and pricing reflect the actual product.
  • You will deliver within the timelines advertised on each tier.
  • You will respond to buyer messages in a commercially reasonable timeframe (typically within 24 hours on business days).
  • You will honor revisions, refunds, and dispute outcomes as specified by these Terms and the Refund Policy.
  • Your content is free of malware, hidden telemetry, backdoors, credential-harvesting code, or any functionality intended to harm the buyer's server, players, or data.

Sellers are solely liable for the content they list and for disputes arising from their listings, except where this Marketplace's own conduct has caused the dispute.

5. Buyer Obligations

If you purchase content on the Marketplace, you agree that:

  • You will review the gig description, compatibility requirements, and tier inclusions before ordering.
  • You will not initiate fraudulent chargebacks. Disputes should be raised with the seller first, then escalated through the Marketplace's dispute process.
  • You will not redistribute, resell, or publicly share purchased content in violation of the license terms granted by the seller.
  • You will not use the Marketplace to acquire content intended to harm other FiveM servers, players, or third parties.

6. Intellectual Property & Licensing

Unless a seller explicitly grants different terms on their gig page, purchases on the Marketplace are subject to a standard work-for-hire license: you receive the right to use, modify, host, and extend the purchased content on server(s) you operate. You do not receive the right to:

  • Resell the content (in identical or substantially similar form) as a commercial product.
  • Sublicense or redistribute the content to third parties outside your server.
  • Claim authorship of content you did not create.

"1of1" or server-locked listings carry additional restrictions as described on their gig pages. Buyers and sellers may also agree to custom licensing terms on a per-order basis; those terms, once agreed in writing, supersede the defaults above for that order.

All trademarks, service marks, and brand names used on the Marketplace that are not owned by us (including "FiveM" which is a trademark of Cfx.re) remain the property of their respective owners and are used for descriptive, nominative purposes only.

7. Prohibited Content

The following content is prohibited on the Marketplace and will be removed on detection or report, with seller accounts subject to suspension or termination:

  • Leaked, cracked, stolen, or otherwise pirated third-party content.
  • Malware, spyware, cheats, exploits, backdoors, or credential-harvesting code.
  • Content that infringes the intellectual property rights of third parties.
  • Content that facilitates real-world illegal activity, harassment, hate speech, or the exploitation of minors.
  • Misleading listings — false compatibility claims, padded descriptions, stolen screenshots, or fake reviews.
  • Content that violates Cfx.re's Platform Server List rules or the FiveM Terms of Service (to the extent such content is hosted on or distributed via FiveM).

8. Fees, Payments & Taxes

Listed prices on the Marketplace are in US dollars unless otherwise shown, and are exclusive of applicable taxes. VAT, GST, sales tax, or equivalent indirect taxes are calculated at checkout based on your billing address and applicable law.

Sellers earn a per-transaction share of each sale as set out in the Seller Agreement provided during seller onboarding. Marketplace fees cover payment processing, vetting, dispute resolution, and hosting of the Marketplace itself.

You are responsible for your own income taxes on earnings through the Marketplace and for providing any tax documentation required by your jurisdiction.

9. Refunds & Buyer Protection

Purchases are covered by the Refund Policy, which forms part of these Terms. The Refund Policy describes eligibility, how to request a refund, and resolution timelines. In the event of a conflict between these Terms and the Refund Policy on a refund-specific matter, the Refund Policy controls.

10. Disputes & Escalation

We encourage buyers and sellers to resolve disputes directly through the per-order message system. If a dispute cannot be resolved within a reasonable timeframe (typically 48 hours), either party may escalate to the Marketplace by clicking "Open dispute" on the order page. Support reviews both sides, the order history, and the listing description before issuing a resolution.

The Marketplace's dispute decisions are binding on both parties as a condition of using the platform. Nothing in this section limits your statutory consumer rights.

11. Termination

You may terminate your account at any time via your account settings or by emailing support@fivem.market. We may suspend or terminate your account if you violate these Terms, engage in fraudulent behavior, or for operational reasons (such as prolonged inactivity). Termination does not affect rights or obligations accrued before termination — including outstanding orders, refund eligibility, and obligations under the Privacy Policy.

12. Disclaimers

The Marketplace is provided "as is" and "as available." We do not warrant that the Marketplace will be uninterrupted, error-free, or secure against every possible attack. Seller content is provided by third parties and is not independently verified for every edge case — vetting reduces risk but does not eliminate it.

To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the Marketplace itself. Individual sellers may make specific warranties about their content on their gig pages; those warranties are between you and the seller.

13. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the Marketplace will not exceed the greater of (a) the fees you paid to the Marketplace in the 12 months preceding the event giving rise to the claim, or (b) US $100.

We will not be liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, lost data, or business interruption), even if advised of the possibility of such damages. Nothing in this section limits liability for gross negligence, willful misconduct, or anything else that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless the Marketplace, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Marketplace, your content (if you are a seller), or your breach of these Terms.

15. Governing Law & Venue

These Terms are governed by the laws of the jurisdiction in which the Marketplace is operated, without regard to its conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection laws in your place of residence grant you the right to bring claims locally — in which case those rights are preserved.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email to registered users and highlighted on this page with a new "Last updated" date. Continued use of the Marketplace after an update constitutes acceptance of the revised Terms. If you disagree with an update, stop using the Marketplace and request account closure.
